A Public Interest Litigation has been filed in the High Court challenging the implementation of the state’s Nava Kerala Welfare Survey, raising concerns over its legality, data privacy, and use of public funds. The petition seeks judicial intervention, alleging that the large-scale data collection exercise lacks adequate statutory backing and clear safeguards to protect citizens’ personal information.

According to the petitioner, the survey involves the collection of sensitive personal and household data, including income details and social status, without clearly defined guidelines on data storage, access, and future use. The plea argues that such an exercise could lead to misuse of information if not governed by a transparent legal framework. It also questions whether informed consent is being properly obtained from participants.

The petition further alleges that the timing and scale of the survey suggest political motivations, especially with elections approaching. It claims that public funds are being spent on an initiative that may not directly translate into improved welfare delivery and calls for a detailed review of its objectives and implementation process.

In response, the state government has defended the survey, stating that its primary purpose is to identify eligible beneficiaries, eliminate duplication in welfare schemes, and improve policy planning. Officials have maintained that the data collection is being conducted responsibly and that safeguards are in place to prevent misuse.

The High Court has taken cognisance of the matter and sought explanations from the government on the legal basis of the survey, the nature of data being collected, and the mechanisms for data protection. The case has drawn attention from civil society groups and policy experts, who view it as a crucial test of how welfare initiatives balance efficiency, transparency, and citizens’ right to privacy.
