The Kerala High Court has recused itself from hearing petitions related to the ongoing nurses’ strike in the state, leading to a rescheduling of the case before a different bench. The development comes amid continued tensions between private hospital managements and nursing staff over salary and working conditions.

The matter was being heard by a single bench when the presiding judge decided to step aside, citing prior professional associations with one of the parties involved in the case. This move was made to ensure impartiality and avoid any potential conflict of interest.

The case will now be taken up by another bench, with the hearing scheduled shortly. The petitions were filed by private hospital associations seeking intervention against the ongoing strike led by nurses demanding higher minimum wages.

The strike has significantly affected the functioning of several private hospitals across Kerala, disrupting routine medical services and raising concerns about patient care. The High Court has earlier observed that healthcare is an essential service and emphasized the need for the government to ensure that critical operations are not impacted.

In previous hearings, the court had also explored whether the state government could invoke the Essential Services Maintenance Act (ESMA) to prevent disruptions in hospital services. However, mediation efforts between hospital authorities and the nurses’ association failed, leading to the continuation of the strike.

The issue has drawn widespread attention, with both sides standing firm on their demands. While nurses are seeking better pay and improved working conditions, hospital managements have expressed concerns over financial feasibility.
